Agreement to These Terms
These Terms of Service ("Terms") are an agreement between you and KEYZ Media ("we", "us", or "our"). They cover your use of First and Geek, the website at https://firstandgeek.com, and any related apps and services we offer (together, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Our Privacy Policy at https://firstandgeek.com/privacy-policy/ explains how we collect, use, and share personal information when you use the Service.
Who Can Use the Service
You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, you may use the Service only with the permission of a parent or legal guardian who agrees to these Terms for you. You may not use the Service if the laws that apply to you prohibit it.
Acceptable Use
You agree not to misuse the Service. In particular, you will not:
- break the law, or help anyone else break it;
- infringe anyone's intellectual property, privacy, or other rights;
- send or upload malware, spam, or content that is fraudulent, harassing, hateful, or that sexually exploits children;

- interfere with or disrupt the Service, including by overloading it or getting around its limits or security measures;

- copy, modify, reverse engineer, or resell the Service, except where the law expressly allows it; or
- pretend to be someone else or misrepresent who you are.
Our Intellectual Property
The Service, including its software, design, text, graphics, and trademarks, belongs to us or our licensors and is protected by law. Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable, and revocable license to use the Service for its intended purpose. We keep all rights we do not expressly grant. If you send us feedback or ideas, we may use them without any obligation to you.
Third-Party Links and Services
The Service may link to or work with websites, products, and services that we do not own or control. We are not responsible for them, and their own terms govern your use of them.
Suspension and Termination
You can stop using the Service at any time. We may suspend or end your access if you break these Terms, if the law requires it, or if continuing would expose us, you, or others to harm. Where reasonable, we tell you first. Sections that by their nature should continue, such as those on payment, ownership, disclaimers, limitation of liability, and disputes, survive termination.
Disclaimers
We work to keep the Service reliable, but we provide it "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and we do not promise that the Service will be uninterrupted, secure, or free of errors.
Limitation of Liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to the Service or these Terms. Our total liability for all claims relating to the Service or these Terms is limited to the greater of the amount you paid us in the 12 months before the event that gave rise to the claim, or US$100.
Your rights under the law. Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, such as liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all the rights consumer protection law gives you, and these Terms do not take them away.
Indemnity
To the extent the law allows, you agree to defend and compensate us for claims, losses, and costs, including reasonable legal fees, that arise from your misuse of the Service or your breach of these Terms.
Disputes
If you have a concern, please contact us first at legal@firstandgeek.com. Most problems can be solved informally, and we will try in good faith to do so within 30 days.
These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Any dispute that we cannot resolve informally will be heard by the courts of the State of California.
If you are a consumer living in the European Union, the European Economic Area, or the United Kingdom, you also keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in its courts.
Changes to These Terms
We may update these Terms from time to time. For material changes, we will give at least 30 days' notice before they take effect, by email or by a notice in the Service. Changes required by law, or that only affect new features, may take effect sooner. The Effective Date at the top shows when these Terms last changed. If you do not agree to a change, stop using the Service before it takes effect and cancel any subscription. If you keep using the Service after a change takes effect, you accept the updated Terms.
General Terms
These Terms are the entire agreement between you and us about the Service and replace any earlier agreements on the same subject. If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a right, we have not waived it. You may not transfer your rights under these Terms without our written consent. We may transfer ours as part of a merger, acquisition, or sale of assets, or otherwise where it does not reduce your rights. Neither party is liable for delays or failures caused by events beyond its reasonable control.
